GENERAL CLARIFICATION TEXT

DEFINITIONS

In this clarification text;

Data Protection Law (KVKK): The Personal Data Protection Law No. 6698, which entered into force after being published in the Official Gazette on April 7, 2016,

Personal Data: Any information relating to an identified or identifiable natural person,

Company: Cırgalan Mah. 4140.Cd. No:2, 38110 Kocasinan/Kayseri, Tuled Elektronik San. ve Tic. A.Ş,

Relevant Person: The natural person whose personal data is processed,

Data Processor: The natural or legal person who processes Personal Data on behalf of the Data Controller based on the authorization granted by the Data Controller,

Data Controller: The natural or legal person who determines the purposes and means of processing Personal Data and is responsible for the establishment and management of the data recording system,

refers to.

DATA RESPONSIBLE

Pursuant to Law No. 6698 on the Protection of Personal Data (KVKK), your personal data will be processed by Tuled Elektronik Sanayi ve Ticaret Anonim Şirketi, in its capacity as Data Controller, by using, recording, storing, storing, updating, transferring and/or classifying your personal data within the framework described below, depending on the business purposes.

OBLIGATION OF THE DATA CONTROLLER

In this context, all technical and administrative measures are taken by our Company to ensure the appropriate level of security in order to prevent unlawful processing of your personal data, to prevent unlawful access and processing and to ensure the protection of your personal data in accordance with the Law, Regulations and Communiqués regulated in order to protect the fundamental rights and freedoms of individuals, especially the privacy of private life, and to protect personal data.

Fulfillment of our legal obligations arising from the legislation,
To provide you with Company services, to fulfill our obligations to you, to organize records and documents, to comply with information retention, reporting, disclosure, tax and other obligations stipulated by local and international legal legislation,
Fulfillment, execution, performance, proof and development of transactions regarding our obligations, reporting, fulfillment of the contracts you have concluded and / or we have concluded;
Statistics and satisfaction studies,
Pursuant to Law No. 6563 on the Regulation of Electronic Commerce, previously open

Your personal data is processed for the purpose of creating and tracking visitor records.

SITUATIONS THAT DO NOT REQUIRE EXPLICIT CONSENT

Pursuant to the KVKK, it is possible to process personal data of general nature without seeking your explicit consent in the presence of one of the following conditions listed in the Law;

It is explicitly stipulated in the laws,

It is mandatory for the protection of the life or physical integrity of the person who is unable to disclose his consent due to actual impossibility or whose consent is not legally valid, or of another person
Provided that it is directly related to the conclusion or performance of a contract, it is necessary to process personal data of the parties to the contract
It is mandatory for our Company to fulfill its legal obligation as the data controller,
It has been made public by the person concerned,
Data processing is mandatory for the establishment, exercise or protection of a right
Data processing is mandatory for the legitimate interests of our Company, provided that it does not harm the fundamental rights and freedoms of the data subject.

TRANSFER OF PERSONAL DATA

Pursuant to Articles 8 and 9 of the KVKK No. 6698, with the principles and purposes set out in the Privacy and Personal Data Protection Principles, your personal data may be transferred to third parties (the COMPANY’s business partners, shareholders, affiliates, cooperating institutions, Tax Procedure Law, Social Security Institution Legislation deemed necessary within the framework of the Personal Data processing conditions and purposes in order to maintain the activities of our Company within the scope of the above-mentioned purposes, Public institutions and organizations, private law persons or foreign countries permitted by the provisions of the Turkish Commercial Code, the Code of Obligations and other legislation, Product / service comparison, analysis, evaluation and real or legal persons from whom we receive services in the realization of the above-mentioned purposes, to whom we cooperate, to the institutions we have contracted to send the messages we send to our personnel) may be transferred.

METHOD AND LEGAL REASON FOR COLLECTING PERSONAL DATA

Your personal data may be collected by automatic or non-automatic means, in written, verbal or electronic media, through our Company’s Head Office, Office, General Communication, Purchasing Communication, Feedback, Job Application Form and Job Application Form for Open Job Positions, Personnel Files, parties from which our Company receives services that are complementary or extension of our Company’s activities, contracted organizations, business partners, suppliers and sub or supercarriers and through other similar channels, by filling out an application form in electronic media or by filling out a physical form.

1) Employee / Employee candidate personal data, provided that it is directly related to the establishment or performance of a contract in the context of the established employment contract / employment contract that may be established, provided that the processing of personal data belonging to the parties to the contract is necessary, provided that it does not harm the fundamental rights and freedoms of the person concerned, based on the legal reasons that data processing is mandatory for the legitimate interests of the data controller or by obtaining explicit consent;

It is processed automatically, partially automatically or non-automatically provided that it is part of any data recording system, by filling out an application form in electronic environment, filling out a physical form, preparing a personal file as part of the data recording system by obtaining it from the person personally or from a third party;

2) Based on the legal reason that it is clearly stipulated by law and is mandatory for the data controller to fulfill its legal obligation;

3) Based on the legal reason that data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject;

Conducting customer relations,
Follow-up of financial transactions,
Carrying out the necessary work by our business units and carrying out the relevant business processes in order to enable the relevant persons to benefit from the products and services offered by our Company, including the sales and marketing activities of our products and services

It is processed by physical, electronic media, written or verbal data transfer tools and non-automatic means provided that it is part of the data recording system.

4) Visitor personal data, on the legal grounds that it is mandatory for the data controller to fulfill its legal obligation, that data processing is mandatory for the establishment, exercise or protection of a right, and that data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject;

Ensuring the security of the building and facility campus and / or facilities,
Creation and follow-up of visitor records,
Ensuring the security of its fixtures and/or resources,
Ensuring the security of company operations and
Providing information to authorized institutions and organizations due to legislation

It is processed automatically or non-automatically, provided that it is part of any data recording system, by recording images by means of security cameras located in various places within our service building and other information received by you during your entries.

5) 3rd person personal data, based on the legal reasons that it is mandatory for the data controller to fulfill its legal obligation, provided that it does not harm the fundamental rights and freedoms of the person concerned, and that data processing is mandatory for the legitimate interests of the data controller;

Carrying out the necessary business and operational processes in order to benefit from the services offered by the Company,
Follow-up of legal affairs and performance of the contract

It is processed by physical, electronic media, written or verbal data transfer tools and non-automatic means provided that it is part of the data recording system.

6) Carrying out the necessary work by our relevant business units for the realization of the commercial activities carried out by our Company and carrying out the related business processes,

7) Ensuring the legal, technical and commercial-business security of our Company and the relevant persons who are in business relations with our Company,

8) Determining and implementing the commercial and business strategies of our Company,

9) Follow-up and execution of legal affairs,

10) Execution of information security processes,

11) Planning and execution of customer satisfaction and corporate communication activities,

12) Retention of personal data during the general statute of limitations in order to constitute evidence in possible future disputes.

RIGHTS OF THE PERSONAL DATA OWNER

Pursuant to Article 11 of the LPPD, everyone can apply to the data controller and request information about him/her;

To learn whether his/her personal data is being processed or not,
Request information if their personal data has been processed,
To learn the purpose of processing personal data and whether they are used for their intended purpose,
To know the third parties to whom personal data are transferred domestically or abroad,
To request correction of personal data in case of incomplete or incorrect processing,
To request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the KVKK,
To request notification of the transactions made pursuant to subparagraphs (d) and (e) to third parties to whom personal data are transferred,
To object to the emergence of a result to the detriment of the person himself/herself by analyzing the processed data exclusively through automated systems,
In case of damage due to unlawful processing of personal data, to demand compensation for the damage,

Depending on the nature of your request, your applications will be finalized free of charge as soon as possible and within thirty days at the latest; however, if the transaction requires an additional cost, you may be charged a fee according to the tariff to be determined by the Personal Data Protection Board.
