ARTICLE 2 – SUBJECT
The subject of this contract is Law No. 4077 on the Protection of Consumers and the Principles of Implementation of Distance Contracts regarding the sale and delivery of the product whose qualifications and sales price are specified below, which the CONSUMER ordered electronically from the SELLER’s “www.tuled.com.tr” website. It is to determine the rights and obligations of the parties in accordance with the provisions of the Regulation on Law and Procedures.
ARTICLE 3 – PRODUCT SUBJECT TO THE CONTRACT
The type and type, quantity, brand/model, color, and sales price of the products are stated on the website.
ARTICLE 4 – GENERAL PROVISIONS
4.1- CONSUMER declares that they have read and informed the preliminary information regarding the basic characteristics of the product/s subject to the contract, sales price payment method, and delivery on the Tuled website and has given the necessary confirmation electronically.
4.2- The material product subject to the contract is delivered to the CONSUMER or the person/organization at the address indicated within the period specified in the preliminary information on the website, depending on the distance of the CONSUMER’s residence for each product provided that it does not exceed the legal 30-day period.
4.3- The virtual/software product subject to the contract can be used electronically for each product under the membership opened on behalf of the CONSUMER on the Tuled website or delivered usable via the link specified in the CONSUMER’s registered email address, provided that it does not exceed the legal 30-day period. Physical shipping is not offered for this product type.
4.4- Tuled is responsible for the delivery of the virtual/software product subject to the contract in accordance with the qualifications specified in the order and with the user manual(s), if any.
4.5- For the delivery of the product subject to the contract, the signed copy of this contract must be delivered to Tuled, or the CONSUMER’s approval must be obtained electronically via the Tuled website by the CONSUMER or based on the confirmation email sent to the CONSUMER’s registered email address, and the price must be paid to the CONSUMER. It must be paid via the preferred payment method. If the product price is not paid for any reason or is canceled in bank records, Tuled is deemed to be free from its obligation to deliver the product.
4.6- After the delivery of the product, if the relevant bank or financial institution does not pay the price of the product to Tuled due to the unfair or unlawful use of the CONSUMER’s credit card by unauthorized persons in a way that is not due to the CONSUMER’s fault, the CONSUMER will receive financial compensation provided that it has been delivered to him. The product must be returned to Tuled within three days. If the product is virtual/software, Tuled has the right to cancel the activation of the license key immediately. In this case, shipping costs for tangible products belong to the CONSUMER.
4.7- If Tuled cannot deliver the product subject to the contract within the period due to force majeure or extraordinary circumstances such as adverse weather conditions that prevent transportation of material products or interruption of transportation, it is obliged to notify the CONSUMER of the situation. In this case, the CONSUMER may exercise one of the rights to cancel the order, replace the product subject to the contract with a comparable product, if any, and postpone the delivery time until the hindering situation disappears. If the CONSUMER cancels the order, the amount paid will be paid in cash and in a lump sum within 15 days.
4.8- People under the age of 18 cannot shop from Tuled.
4.9- Tuled is not responsible for price inaccuracies caused by typesetting and system errors.
4.10- Tuled has the right to change or cancel the content, scope, and features of all products sold on its website.
4.11- If the order is placed, the BUYER is deemed to have accepted all the conditions of this contract.
ARTICLE 5 – RIGHT OF WITHDRAWAL
The CONSUMER has the right to withdraw for tangible products within 14 days from the delivery of the product/s subject to the contract to them or the person/organization at the address indicated within the rules specified in Article 6 of this contract. To exercise the right of withdrawal, Tuled must be notified by fax, email, or telephone within this period, and the product must not have been used within the framework of the provisions of Article 6. If this right is exercised, it is mandatory to return a copy of the cargo delivery document stating that the material product delivered to the third party or the CONSUMER was sent to Tuled, along with the original invoice. For tangible products following the receipt of these documents, the price of the product is paid to the CONSUMER within 15 days. The shipping cost of the material product returned due to the right of withdrawal is borne by the CONSUMER. Refunds can only be made by presenting the original invoice.
ARTICLE 6 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
The right of withdrawal cannot be exercised for products, services, modules, disposable products, domain names, copyable software and programs, consumables, products that deteriorate quickly or have expired, and products offered as services that cannot be returned due to their nature.
ARTICLE 7 – 14 DAYS RETURN POLICY
You may return the Product to Tuled and receive a refund (excluding gift wrapping fees and similar charges) provided that you contact Tuled within fourteen (14) calendar days from the delivery date of the Product.
Please note that if the Product that Tuled supplied to you is closed and unused and has been used for more than 14 days, you cannot return the Product and request a refund. You cannot get a refund for a service you started using.
If a Product has been supplied by mistake, needs to be added or corrected, or you believe you are authorized to have it repaired, please call Tuled on 0352 440 5840, Monday through Friday, 8 am—5.30 pm.
ARTICLE 8 – COMPETENT COURT
In implementing this agreement, Consumer Arbitration Committees and Consumer Courts in Tuled’s place of residence are authorized up to the value declared by the Ministry of Industry and Trade.
